Your trust is very important to us and we are dedicated to ensuring your data remains secure. That is why we want to be completely transparent about why we need your personal details and how we will use them. 

1 WHO WE ARE

GAIN  Gift Aid Consultancy (‘GAIN ‘) is an sole proprietor consultancy specialising in Gift Aid and Tax Efficient Giving consultancy

GAIN  will be registered as a Data Controller and Data Processor under the new General Data Protection Regulation.

2 WHY WE COLLECT INFORMATION

We collect information about you in order to

  • respond to your enquiries regarding any and all Gift Aid matters
  • process Gift Aid claims in accordance with your instructions and as required by HMRC’s Gift Aid regulation Gift Aid, specifically, but not limited to, the information provided in a Gift Aid Declaration.
  • advise you of any relevant Gift Aid information such as changes in Gift Aid legislation, upcoming Gift Aid events and relevant Gift Aid training seminars and similar events.

3 WHAT INFORMATION WE COLLECT ABOUT YOU

The information we may collect about you may include, but is not limited to, any of the following:

  • your name, age/date of birth and gender;
  • your contact details: postal address including billing and delivery addresses, telephone numbers (including mobile numbers) and e-mail address;
  • records of your donation history and orders made by you;
  • when you make a purchase or place an order with us, your payment card details, including your Gift Aid status;
  • your communication and marketing preferences;
  • your correspondence and communications with RCB;
  • information you enter onto our website, including details to take part in events (such as your date of birth and contact information). other publicly available personal data, including any which you have shared via a public platform (such as a Twitter feed or public Facebook page);
  • images, photographs or video if you take part in an event with us
  • any other details you give us, including your reasons for supporting us and feedback on events.

4 HOW WE USE YOUR INFORMATION

We will never rent, swap or sell your personal information to other organisations.

Depending on the circumstances in which your data are collected and used, the legal basis that we rely on for processing your data will generally fall into one of the following categories:

  • Where you have given your consent to allow us to use your data in a certain way;
  • Where you have given your consent to allow us to use your data in our marketing or PR material;
  • Where the processing is necessary in order to deliver a contract with you;
  • Where the processing is necessary to comply with a legal obligation;
  • Where it is in our legitimate interests to perform our functions, such as:
    • processing donations or gifts in kind;
    • sending you communications (via email or mail) where our legitimate interest is to raise funds and to deliver our charitable objectives.

5 HOW WE KEEP YOUR DATA SAFE

  • We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.
  • Despite all of our precautions, no data transmission over the internet can be guaranteed to be 100% secure. So, whilst we strive to protect your personal information, we cannot guarantee the security of any information which you disclose to us and so wish to draw your attention that you do so at your own risk.

6 HOW WE CONTACT YOU

You decide how you want us to contact you, whether by mail, email or by phone, and you decide what communications you want to receive from us. You can update your communication preferences at any time by telling us when things change:

From time to time, we will send you a communication to review your communication preferences. You can also change your mind about how we contact you at any time or request that we stop contacting you altogether. If you tell us that you no longer want to receive contact from us and you are on our database, it may take a short while before our communications stop altogether. If you request to receive no further contact from us, we will keep the information we hold on you and mark your record as ‘no mail’ to ensure that you do not receive unwanted materials in the future.

Service providers

We currently do not use service providers (such as direct mailing companies, marketing campaign providers and software platform providers) to help us deliver our services to you. However, should things get to a point when we need additional third-party help, we will ensure we have a contract with the supplier and that as part of that agreement the supplier agrees to respect the security of your personal data and to treat it in accordance with the law. We will only permit suppliers to process your personal data for specified purposes and in accordance with our instructions.  

Legal requirements

We may disclose your personal/sensitive information when required to by law, for example, to HMRC for tax purposes.

7 KEEPING YOUR INFORMATION UP TO DATE

Please help us keep our records up to date by informing us when your contact details and other personal information changes.

8 HOW LONG WE KEEP YOUR DATA FOR

We will only keep your personal information for as long as is necessary for the purpose for which it is collected, which may include the purpose of satisfying any legal, accounting or reporting requirements. If you request that we stop sending you marketing materials, we will keep a record of your contact details and the appropriate information to enable us to comply with your request not to be contacted by us.

9 WEBSITE PRIVACY

Personal information gathered via our contact form on the website will be collected, used and stored for processing as per ‘How we use your Information’ (above). We collect and process personal information when you register for events, subscribe to a service (such as our e-newsletter), make a donation, or otherwise give us personal information. You can change your consent or identify specific activities or marketing/ fundraising updates that you are interested in at any time.

Under 16

If you are 16 or under, you must get your parent/guardian’s permission before you provide any personal information on the website. If you do not have permission, you are not allowed to give us your personal information.

10 COMPLAINTS

We are committed to working with you to obtain a fair resolution of any complaint or concern about privacy. If you have a complaint, please contact us in the first instance and we hope to be able to resolve it. If, however, you believe that we have not been able to assist with your complaint or concern, then you have the right to make a complaint to the data protection authority in the UK, which is the Information Commissioner.

You can contact the Information Commissioner’s Office at ico.org.uk to find out more or report a concern. They are the UK’s independent authority set up to uphold information rights in the public interest, promoting openness by public bodies and data privacy for individuals. We work with them to make sure that we collect, store and use your information appropriately and don’t do anything you wouldn’t expect us to.

11 CHANGES TO THIS POLICY

This policy was updated in May 2018 to give you further information about how we collect, use and store your personal data, and to reflect the changes in law as set out in the General Data Protection Regulation and to give you more clarity on how we use your data, and your rights in relation to it.

We may amend or update this policy at any time to take account of any changes to data protection law or other legislation. When further updates to the policy are made they will be posted on this page, so please check back here regularly. Any significant changes will be notified to you.
